In a recent Law360 article titled “Ill. Insurance Ruling Helps Developers, Community Orgs. Alike,” Suzanne Karbarz Rovner and Howard Dakoff shared their analysis of a recent Illinois Supreme Court decision upending decades of Illinois caselaw regarding coverage under commercial general liability (CGL) policies.

“Until the Illinois Supreme Court’s decision in Acuity, access to insurance coverage for damage associated with defective work was denied, contrary to most other states’ interpretation of the same policies, exclusions and endorsements. The Acuity case modernizes Illinois law on CGL coverage, taking a position that has been advocated by industry stakeholders for well over a decade.”
