Update: New Year, New Eviction Moratorium Extensions

Last week we informed you that the CDC’s residential eviction moratorium had been extended through January 31, 2021. On Friday, January 8, 2021, Governor Pritzker issued an executive order once again extending the Illinois eviction moratorium. The Illinois moratorium was scheduled to expire on January 9, 2021, and has now been extended through February 6, 2021. If you are wondering how the moratorium is playing out in the courts, at least in Cook County, Illinois, for cases that were filed pre-COVID, most judges are setting the cases for trial and entering eviction orders but staying enforcement of those orders until after the expiration of the moratorium. If the stay on enforcement expires and the moratorium is still in place the judges have acknowledged that the sheriff will not enforce the eviction order until the moratorium is lifted. If the eviction was filed post-COVID, then the tenant must fall into one of the exceptions/landlords must meet the requirements we first told you about here in order to proceed.
