Jason Hirsh Discusses Standing in the Context of Data Breach Lawsuits in an Article Published by Inside Counsel

In the article, “Will standing remain an obstacle to data breach lawsuits in the 7th Circuit?” published by Inside Counsel, Litigation Partner Jason Hirsh discusses the meaning and impact of the Supreme Court decision in Clapper v. Amnesty Inc. Since the decision, courts in the Northern District of Illinois have applied Clapper and dismissed putative class actions on the basis of lack of standing. However, two of these rulings are currently making their way through the appellate process in the Seventh Circuit. Thus, the Seventh Circuit is now poised to determine whether standing remains an effective defense in data breach lawsuits.
