White Collar Criminal Defense & Corporate Internal Investigations

Overview

LP attorneys have substantial experience in conducting corporate internal investigations and in defending companies and individuals in a variety of criminal matters. In such matters - when threats to a company’s survival and/or an individual’s freedom are so striking - we pursue a multidisciplinary approach that combines expertise in various substantive areas of the law with procedural know-how to guide clients through the rocky shoals of a criminal investigation or prosecution.

Because many government investigations can, and should, be resolved short of indictment or trial, we focus our efforts on gaining a command of the facts underlying the investigation, the law applicable to those facts, and the policy reasons why the investigative authority should not pursue criminal charges against a client. By conducting our own aggressive investigation, we learn quickly whether our clients’ interests are best served by cooperation and negotiation or by putting the government to its proof at trial. In most cases, it is the former, and we have a strong track record of resolving investigations short of indictment or plea.

LP attorneys have served as federal prosecutors and defenders, state-level prosecutors and defenders, and regulatory enforcement officials (including EPA, SEC, and NASD). Additionally, our attorneys have built strong relationships with local courts and prosecutors, allowing us to serve as both lead and local counsel depending on our clients' needs.

These latter representations are a necessity in situations where other outside counsel for the company may be “conflicted out” of representing a board, a committee, or an individual employee. In this regard, LP’s extensive experience in civil litigation provides us with the depth of substantive knowledge to conduct focused, effective investigations and defenses.
