Kerry Davidson is an associate in Levenfeld Pearlstein’s Labor & Employment Service Group and Litigation Practice Group. She represents and counsels employers in the many facets of employment and labor law, including matters in state and federal courts and before administrative agencies.
In her career, she has successfully defended claims filed under Title VII, FLSA, FMLA, ADA, ADEA, OSHA, NLRA, ERISA and other employment statutes, including a class action involving “off the clock” wage and hour claims by more than 2600 union employees and other multiple plaintiff employment discrimination actions. Kerry has also successfully defended common law breach of contract, wrongful termination and restrictive covenant claims. In addition, she actively counsels employers regarding contract and policy drafting and other compliance concerns, and has experience with traditional labor (union) matters, including contract negotiations, arbitrations and election campaigns. Most recently, Kerry helped a client successfully defeat a union organizing attempt at one of the only non-union residential buildings in Chicago’s “Magnificent Mile.”
While earning her law degree, Kerry worked full time as a labor relations representative and EEO specialist at Northern Indiana Public Service Company. Before practicing at a firm, she also worked in the labor/employment relations department at Rush University Medical Center. These roles included:
- Gatekeeper of the employer’s Anti-Harassment/Discrimination and Complaint Policies
- Management training, including implementation of Title VII compliance program
- Assisting in union negotiations and attending to interim union issues
- Representing management interests in the grievance process, including conducting arbitrationsKerry regularly teaches seminars on employment and labor law for continuing education providers or based upon client needs and has served as an adjunct professor for Rush University and Northern Illinois University. She is certified as a Senior Professional in Human Resources (SPHR) and has written labor law updates for the Committee on Law and Legislation of the National Academy of Arbitrators. She is an Associate Editor of the Age Discrimination in Employment Law treatise, and has also contributed to recent editions of the American Bar Association’s Employment Discrimination, The Developing Labor Law and Age Discrimination in Employment Law treatises. Kerry is also a member of the Future Leaders Council (the associate Board of Directors of the Metropolitan Chicago YWCA) and actively involved in the YWCA’s Economic Empowerment Institute, which provides career planning and promotes financial sustainability for Chicago area women.
