Employee Benefits & Executive Compensation Service Group

Focus

The area of employee benefits and executive compensation has become increasingly complex in recent years. Providing legal advice in this area requires knowledge not only of ERISA and related benefits statutes, but also of tax and securities laws. We rely upon a cross-functional team of benefits, employment, corporate, and tax attorneys to provide seamless advice to our clients. We not only help our clients navigate the legal complexities, but also help them think through the practical and business issues associated with their employee benefits and executive compensation decisions.

Overview

The Employee Benefits and Executive Compensation Service Group represents large companies, companies in the middle market, third party administrators, ERISA fiduciaries, and senior executives in a wide range of benefits and compensation matters.

For companies, we assist with the development and implementation of executive compensation arrangements as well as the design and administration of pension, health, welfare, and other fringe benefit plans. We also provide advice to companies in corporate transactions by conducting due diligence on benefits matters and advising on deal terms and transition issues.

A large part of our practice involves the preparation and negotiation of employment contracts and severance agreements. We have represented Fortune 500 companies as well as C-level executives of both public and private companies in this area.

The Employee Benefits & Executive Compensation Service Group also assists in resolving employee benefit plan claims and controversies, including benefit claim disputes, ERISA breach of fiduciary duty claims, and IRS and U.S. Department of Labor audits.
