Overview

Transactional Services
Attorneys from LP’s Construction Law Service Group, as well as its Real Estate Practice Group, are experts in the nuances of construction contracting. Across both these groups are experienced LP attorneys who regularly draft and negotiate the highest quality construction contracts for a wide variety of clients. Such drafting does not necessarily mean crafting the “toughest” contract possible. One sided contracts often lead to more problems than they solve, such as protracted contract negotiations and contractors who end up sacrificing work quality for contract driven, self-protective behavior. LP’s approach is to draft and negotiate construction contracts that protect our clients interests while also maximizing the chances for the project being completed efficiently, on time and on budget. LP’s construction attorneys also have the advantage of working closely with attorneys from the firm’s Community Associations Practice Group, Real Estate Practice Group and Risk Management Service Group, who are experts in their own right in the field of construction law as it applies to their practice areas. LP’s interdisciplinary approach provides seamless representation from project conception, through acquisition (as necessary), contracting and build out. Our attorneys are also on hand to handle any and all claims and disputes that arise during the course of a construction project, whenever such problems occur.
Litigation Services
Every substantial construction project has unique characteristics and requirements, in addition to run of the mill issues, that can lead to a wide array of disagreements and controversy during the project and afterward. Ordinarily, when construction problems develop, general contractors, construction managers, architects and project engineers succeed on their own in sorting-out contractual responsibilities, making necessary adjustments and keeping construction on or close enough to schedule and budget. LP’s construction attorneys, however, are able to assist our clients through the potential minefields of an ongoing construction project , with an experienced eye toward avoiding future litigation.
To avoid disputes, and to resolve them quickly and favorably when they arise, one of LP’s construction litigators often will assist the firm’s real estate attorneys in the planning stages of a project to help design procedures for resolving through mediation or arbitration many types of issues that commonly arise during construction. This often proves to be instrumental in reaching an economically favorable result for our clients, and avoiding protracted and costly litigation.
When the contractual process fails, the extensive experience possessed by LP’s construction litigation attorneys in resolving disputes over complex as well as common construction issues provides welcome relief to our clients. Representing real estate developers, owners, contractors, subcontractors, architects and condominium associations in construction defect, design defect, delay and mechanic’s lien lawsuits, for many years has been an essential part of our litigation practice.
Before and after a construction lawsuit erupts, our litigation attorneys utilize their close working relationships with leading construction experts to analyze the sufficiency of evidence for prosecuting or defending the case, or positioning it for favorable pre-trial settlement. Our early preparation also includes review of any insurance policies providing coverage for the dispute and securing that coverage from the insurer(s).
